UK CMA Proposes 'Strategic Market Status' for Microsoft's Commercial Software

The UK Competition and Markets Authority (CMA) plans to designate Microsoft's commercial software with a 'strategic market status,' which could allow regulators to intervene in product bundling practices involving Excel, Teams, and the AI assistant Copilot. This proposal follows an ongoing investigation initiated in May into whether Microsoft's strong market position in operating systems, productivity, and cloud services restricts fair competition. This regulatory action could significantly impact Microsoft's business model by restricting how it bundles AI tools and enterprise software, potentially leveling the playing field for rival providers like Google Workspace. Furthermore, it marks a major enforcement step under the UK's emerging digital market regulations to ensure businesses and public services maintain freedom of choice. The CMA will accept feedback on the proposal before making a final decision by February 2027, and if approved, Microsoft will become the third tech giant bound by the UK's new digital market rules. Additionally, the regulator is scrutinizing Microsoft and Amazon Web Services (AWS) over remaining barriers that hinder customers from switching or combining multiple cloud service providers.

## BACKGROUND

Strategic market status is part of the UK's regulatory framework under the Digital Markets, Competition and Consumers Act, designed to oversee major tech firms with substantial market power. Tech giants designated with this status face targeted conduct requirements and heightened scrutiny to prevent anti-competitive behaviors and ensure digital market openness.
