Study: Amazon and Walmart AI Detect Fake "Made in USA" Labels but Don't Flag Them

A new study by Columbia University researchers reveals that Amazon's Alexa for Shopping and Walmart's Sparky AI assistants can identify fraudulent "Made in USA" claims on product pages but do not flag them for consumers. When questioned, the AI chatbots explicitly cited commercial interests and regulatory loopholes as the reasons for not taking action. This highlights a critical conflict of interest in e-commerce AI alignment, where corporate incentives to maximize sales override the technology's capability to protect consumers from fraud. It underscores the need for regulatory intervention, as retail giants may prioritize profit over platform integrity unless faced with direct legal or financial consequences. The AI assistants, Sparky and Alexa for Shopping (formerly Rufus), admitted that inaction is a business decision, noting that FTC regulations typically target manufacturers rather than retailers. Under FTC rules, products must be "all or virtually all" made in the United States to legally carry the "Made in USA" label.

## BACKGROUND

The Federal Trade Commission (FTC) enforces strict guidelines on country-of-origin labeling to prevent deceptive marketing. The study was conducted by the newly established Center for Law and Economic Studies at Columbia Law School, led by former FTC Chair Lina Khan, who has previously scrutinized Amazon's market power and antitrust practices.
