EU Considers Designating ChatGPT and Roblox as Very Large Online Platforms

The European Commission announced that ChatGPT and Roblox may soon be designated as Very Large Online Platforms (VLOPs) or Very Large Online Search Engines (VLOSEs) under the Digital Services Act (DSA). This potential designation comes as both platforms have reported user numbers that exceed the EU's regulatory threshold. If designated, ChatGPT and Roblox will face much stricter compliance requirements, including mandatory risk assessments, enhanced content moderation, and detailed transparency reporting. This highlights the EU's growing regulatory scrutiny over generative AI and gaming platforms as they reach massive user bases. Under the DSA, platforms designated as VLOPs or VLOSEs have exactly four months to comply with the stricter rules once the official decision is made. These platforms are also required to update and publish their active user numbers at least every six months.

## BACKGROUND

The Digital Services Act (DSA) is an EU regulatory framework designed to create a safer digital space by regulating online intermediaries and platforms. Platforms with more than 45 million monthly active users in the EU are classified as VLOPs or VLOSEs, subjecting them to the highest level of regulatory oversight and potential fines for non-compliance.
