China Proposes Export Controls on 23 AI Technologies

On October 16, 2026, China's Ministry of Commerce and Ministry of Science and Technology proposed draft export controls on 23 AI-related technologies, including foundation models, intelligent agents, and computing clusters. The draft explicitly exempts technologies that have already been made public through open-source releases or academic publications. This regulatory development shapes the global AI landscape by tightening the cross-border transfer of advanced domestic technologies while protecting existing open-source ecosystems. It introduces new compliance requirements for Chinese AI labs such as DeepSeek and Qwen on future releases. Providing access via APIs, apps, or SaaS is generally exempt from the definition of a technology export, whereas overseas local deployment of restricted models may face strict regulations. Temporary pre-export registration requirements took effect immediately, with public comments open until November 15.

## BACKGROUND

Export controls are legal mechanisms used by governments to regulate the transfer of sensitive technologies, software, and goods across national borders to protect national security and economic interests. In the context of artificial intelligence, these rules increasingly target high-performance hardware, advanced computing clusters, and sophisticated model weights.
